Welcome to The Grappler’s S&C Club, operated by HM Performance and Nutrition FZ-LLC (“we”, “us”, “our”). By joining the program, you (“you”, “the user”) agree to be bound by these Terms & Conditions. Please read them carefully before signing up.

1. Program Overview

The Grappler’s S&C Club is a global strength & conditioning membership for BJJ athletes, delivered via the Everfit mobile app. The program includes:

2–3 S&C sessions per week

Optional cardio session add-ons

Monthly program updates and video demonstrations

Access to a private Facebook community

The program is 100% generalised, and all participants receive the same content.

2. Eligibility

By joining, you confirm that:

You are at least 18 years old

You are participating voluntarily and understand that this program does not replace medical advice or personalised coaching

3. Medical Disclaimer

The program is for generally healthy individuals. By joining, you acknowledge:

This is generalised training only, not medical advice, physiotherapy, or personalised fitness coaching

You should consult your doctor before starting if you have any injuries, medical conditions, or are unsure of your fitness readiness

Participation is at your own risk; HM Performance and Nutrition FZ-LLC is not liable for any injury, health issue, or loss

4. Program Access & Delivery

Program content is delivered via the Everfit mobile app

You will receive access immediately upon purchase

Monthly updates and occasional downloadable content may be provided

Technical interruptions, outages, or platform failures are not the responsibility of HM Performance and Nutrition FZ-LLC

5. Payment & Refund Policy

The Grappler’s S&C Club is a 12-month program, with the following payment options:

Full 12-month upfront payment

6-month upfront payment

11 monthly payments of £54.99, following an initial upfront payment of £599

Optional rolling monthly plans (minimum 3 months) may be offered on a case-by-case basis

Payments may be made online or via phone. By completing the onboarding form, you agree to these Terms & Conditions

Refunds: See the 90-day results guarantee below. After the 12-month term, no refunds are available under any circumstance.

5.1 90-Day Results Guarantee

Eligible for first-time users only

Must complete every session programmed for 90 days, ask questions in the Facebook group, and submit form videos to confirm correct execution

Refund requests are only accepted between day 90 and day 95

No refunds are available outside this window

After 12 months, no refunds are available under any circumstance.

6. Intellectual Property

All content, including videos, PDFs, text, and programming, is copyright HM Performance and Nutrition FZ-LLC.
You may not:

Copy, reproduce, distribute, or sell any content

Share login credentials or program materials with others

Claim authorship

Violations may result in account termination and legal action.

7. Community Guidelines

The program includes access to a private Facebook group

By participating, you agree to:

Treat all members respectfully

Refrain from abusive language, harassment, hate speech, or spam

Follow moderator instructions

Community moderation is initially handled by Hayden and may expand to include additional team members. HM Performance and Nutrition FZ-LLC reserves the right to remove any member for inappropriate conduct without refund.

8. Termination

We may suspend or terminate membership without refund for:

Violation of these Terms

Harmful or disruptive behavior

Sharing login credentials or content

Unresolved payment failures

9. Limitation of Liability

To the maximum extent permitted by law, HM Performance and Nutrition FZ-LLC is not liable for:

Injuries or health issues

Loss of training time, income, or personal data

Technical issues, outages, or platform failures

Any expectation of results from participation

Participation is at your own risk.

10. Governing Law

These Terms are governed by the laws of Scotland, and any disputes will be subject to the exclusive jurisdiction of the Scottish courts.
